SuiteCuba.com (or the Agency) is a website designed to facilitate the booking of houses and apartments for rent (Casas Particulares) by visitors looking for accommodation for their holidays in Cuba (Clients).

Acceptance of Terms and Conditions

The use of the offered services in SuiteCuba.com requires the previous acceptance by the Clients and the owners of the associated Casas Particulares of the following Terms and Conditions. In case that the Clients and the owners of the associated Casas Particulares advance to the use of this website, it will be understood that they have given their approval to these Terms and Conditions.

SuiteCuba.com reserves the right to modify these Terms and Conditions at any moment. Any change in the Terms and Conditions will be properly published in the website and will have validity from the date of its publication. Consequently, the Clients and the owners of the associated Casas Particulares are responsible to carefully read these Terms and Conditions periodically.

TERMS AND CONDITIONS FOR THE USE OF SUITECUBA.COM

• 1- The Client is aware and accepts that SuiteCuba.com is only a booking platform of houses and apartments legally authorized to rent by the competent authorities in Cuba (Casas Particulares). SuiteCuba.com acts as link between Clients and Casas Particulares but will not be a contracting party. SuiteCuba.com does not participate in the real transaction made between the Client and the owner of the booked Casa Particular.
• 2- SuiteCuba.com doesn’t own or manage any Casa Particular and has not signed, since it is not possible to do it properly in Cuba, any contract with any associated Casa Particular. Therefore, the Agency can’t be responsible for any possible cancelation of a pre-reservation or reservation, which would only be attributable to the owner of the associated Casa Particular.
• 3- The staff of SuiteCuba will make its best efforts to assure that the owner of the booked Casa Particular will fulfill the arranged agreement. Nevertheless, in the very unlikely situation of a cancelation of booking arranged via SuiteCuba, the agency will make all reasonable efforts to re-arrange the reservation in an alternative Casa Particular with similar location, quality and price.
• 4- The payment of a deposit of guarantee of reservation can be requested to fully confirm a booking. This deposit, once received, will be delivery to the owner of the booked Casa Particular, and will represent the value of the first night’s rent.
• 5- In case of a cancellation of booking for causes attributable to the owner of the booked Casa Particular, besides the pointed out in the topic 3, SuiteCuba, in case that the Client doesn’t give his/her approval to the alternative options given by the Agency, is responsible for the return of the money transferred as guarantee of reservation.
• 6- For any reason, even when the Client has not been directly responsible (cancellation of flight, necessity of change of dates, etc.), in case of cancellation of reservation or no show of the Client to the booked Casa Particular the planned arrival day, the amount deposited as guarantee of reservation will not be refundable.
• 7- In case of needing to change the dates of travel, as mentioned in the point 6, by rule, the deposit won’t be refundable. In any case, when the request of change has been made with enough time in advance, the Agency will make the best efforts to try that the owner of the booked Casa Particular accede to use the deposit to guarantee the new dates of the travel. This step will never be a guarantee since it depends on the will of the owner of the booked Casa Particular. Once we deposit the money to the owner we can only commit to refund it in the very unlikely case of a cancellation for causes attributable to the owner of the Casa Particular.
• 8- The owners of the Casas Particulares listed in SuiteCuba.com and of those others Casas Particulares, than even not listed in the website, but that are used as alternative offers, recognize that SuiteCuba is not responsible for any damage caused by a booking cancellation or the no show of a tourist on the planned day of arrival. They also accept that SuiteCuba has not responsibility for any material or moral damage caused by the Clients or its guest visitors to the Casa Particular. The owners of the Casas Particulares that collaborate with SuiteCuba understand and accept that the Agency has not responsibility for the behavior of the Clients in their premises.

About content in SuiteCuba.com

SuiteCuba is located in Havana. It is a practice of the SuiteCuba staff to visit all the new Casas Particulares positioned in Havana that are listed or collaborate with the Agency. Prior to acceptance of the listing or collaboration with a Casa Particular, premises are reviewed to check if such accommodation has good standards of quality. In the case of the Casas Particulares situated in countryside towns, with certain frequency, some member of the staff travels to the provinces to meet directly the Casas Particulares that collaborate with the Agency. Nevertheless, for obvious reason, is impossible to visit all the provinces. As a result, in many occasions, it is necessary to rely on the information and pictures sent via email by the owners of the Casas Particulares located in the provinces that are interested in collaborating with SuiteCuba.com.

The owners of the Casas Particulares that contact the Agency via email and send images and information of their accommodations are entirely responsible of the veracity and precision of the proportioned information. SuiteCuba cannot be responsible for any inaccuracy in the information or pictures received via email for the owners of the Casas Particulares that wish to list and/or collaborate with the Agency.

Additionally, the Agency cannot be responsible for any change in the conditions of the Casas Particulares listed in the website or used as alternative offers to the Clients, even when these Casas Particulares have been previously visited by a member of the staff. The experience tells that the owners of the Casas Particulares make changes in their properties and don’t inform of these changes to the Agency. Nevertheless, the Client must note that, in the immense majority of the cases, these changes are made to improve the conditions of the accommodations.

The SuiteCuba staff makes the best efforts to avoid any inaccuracy in the information and immediately eliminates from its offers the Casa Particular that has been discovered failing or hiding the trust. Nevertheless, as a result of the mentioned in the above paragraph, SuiteCuba cannot fully assure that the 100% of the information related to the Casas Particulares listed in the website will be free of mistakes or imprecisions. The Clients that use the services of SuiteCuba.com must accept that such inaccuracies can be present in the website and that the Agency cannot be responsible for that. The agency will appreciate that the Client inform of any wrong information regarding an associated house.

Exclusion of liability

SuiteCuba.com, its manager, employees or authorized associated personal won’t be responsible for any damage arisen by the use of this website by the Client or the owner of the associated Casas Particulares related to information and services received by this website; including but not limited to: a loss of income, a loss of opportunity of income, damage suffered by third parties and/or in their properties or any other indirect loss.

As a result, the Client that access the services offered by SuiteCuba.com and the owners of the Casas Particulares listed in the website, or those, that even not been listed but that are used as alternative offers, accept and compromise to not to blame or file a lawsuit against SuiteCuba.com, its manager, employees or authorized associated personal.
